Dlugi.info is GDPR compliant in 27 EU countries

We would like to inform you that the debtor’s consent to the processing of personal data by the seller is not required. The legal basis for the processing of the debtor’s personal data by the creditor without his consent is Art. 6 section 1 letter f) GDPR:

Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular when the data subject is a child.

According to the position of the President of the Personal Data Protection Office:

(…) the debtor must take into account (…) the fact that if she is in default in fulfilling her obligation, her right to privacy may be limited due to the creditor’s pursuit of the amounts due to him. Otherwise, a situation could arise in which the debtor, invoking the right to the protection of personal data (right to privacy), would effectively avoid his obligation to perform and, as a consequence, limit (exclude) the creditor’s right to obtain the payment due to him. Invoking the right to personal data protection would also have to limit the above-mentioned right to sell receivables and take further steps to recover them, provided for in specific regulations.
